What is Title IX?

Title IX is a Federal civil rights law enacted in 1972 that prohibits sex discrimination at educational institutions that receive federal financial assistance.

To ensure clarity, Sex Discrimination is defined as:

Sex Discrimination is defined as behaviors and actions that deny or limit a person’s ability to benefit from, and/or fully participate in the educational programs, activities, or employment opportunities of the University because of a person’s sex. Examples of Sex Discrimination under Title IX include but are not limited to the following.

  • Sexual Harassment
  • Quid Pro Quo Sexual Harassment
  • Hostile Environment Sexual Harassment
  • Sexual Assault (defined as rape, fondling, incest or statutory rape)
  • Dating Violence
  • Domestic Violence
  • Stalking Based on Sex
  • Retaliation
  • Sexual Exploitation

What happens when the Title IX Office receives a Formal Complaint of Sex Discrimination?

The Title IX Coordinator will contact the Complainant(s) and Respondent(s) to review the Title IX process, provide information regarding support/resources, and address questions.

How does the Title IX Office address Retaliation?

Safety is a priority at CBU and Retaliation is a violation of University policy.

Retaliation is defined by CBU's Title IX policy as "intimidation, threats, Coercion, or discrimination against any individual for the purpose of interfering with any right or privilege secured under civil rights laws and regulations, or because the individual has made a report or Complaint, testified, assisted, or participated or refused to participate in any manner in an investigation, proceeding, or Hearing. "

The University will impose sanctions on any Faculty, Student or Staff member found to be engaging in Retaliation.

If sexual misconduct occurs while I was engaging in behavior that was in violation of the Standard of Student Conduct, will I get in trouble?

California Baptist University’s first priority is to prevent Sex Discrimination in all forms. To encourage reporting, the University pursues a policy of offering Reporting Parties of Sex Discrimination limited immunity from being charged with policy violations related to the particular incident. While violations to policy cannot be completely overlooked, the University will provide educational options rather than punishment in such cases. This immunity policy does not apply to the possession of child pornography, which must be reported to law enforcement pursuant to California law.

Do Complainants and Respondents need to go through the Title IX process alone?

No, both parties are provided the opportunity to be accompanied by an Advisor.
